END USER LICENSE agreement PLEASE READ THIS CAREFULLY BEFORE USING THIS SOFTWARE. NOTICE TO USER - By downloading and/or using this Intuisphere software you accept and agree to be bound by the following User Agreement. Software License 2.1 Grant - Intuisphere does not transfer the property of this software to you; the license granted to you is not a sale. 2.2 Installation and Use - You are responsible for the installation of WebAcappella. Your license to use this software is limited to the number of licenses purchased by you. For more information about purchasing additional licenses of WebAcappella please contact Intuisphere through your customer space. You shall not allow others to use, copy or evaluate copies of this software. Paying editions can be used through an unlimited period without paying any regular subscription. 2.3 Sale condition - The right of restitution does not apply in the event of the sale of serial numbers required for the paying versions of the software.

The demo version of WebAcappella allows you to test all the functionalities of the commercial version subject to the limitations displayed on this page (You give your assent to check the compatibility of your hosting service with WebAcappella, particularly the installation of your online shop by using the demo version of WebAcappella before buying a license. No refund request will be considered. After buying a version of WebAcappella, a customer space will be created where you will find your user's license. We strongly recommend you copy this license text on a document that you store on an external device (like a USB key). 2.4 Use Restrictions - You shall use WebAcappella in compliance with all applicable laws and not for any unlawful purpose.
Without limiting the foregoing, use, display or distribution of this software together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, sexual orientation or age is strictly prohibited. Each licensed copy of WebAcappella may be used on two computers belonging to the user. If you install this software onto a multi-user platform, server or network, each and every individual user of WebAcappella must be licensed separately. Others may not use or install your copy of this software. The assignment, sublicense, networking, sale, or distribution of copies of WebAcappella is strictly forbidden without the prior written consent of Intuisphere.
It is a violation of this agreement to assign, sell, share, loan, rent, lease, borrow, network or transfer the use of this software. 2.5 Laptop computer use - If you have purchased a license to use WebAcappella and installed it on your desktop computer, you may install a second copy of WebAcappella on your laptop computer for your exclusive use only. 2.6 Transfer - You are allowed to transfer WebAcappella to another computer. Once you do this, you must uninstall the software from the first computer. You should make one backup copy for back-up use during emergency situations. 2.7 Intellectual Property Restrictions - Intuisphere’s name, trademarks, logo and graphics file that represents this software shall not be used in any way to promote products developed with WebAcappella. This software contains copyrighted material, trade secrets and other proprietary material.
You will not deliver, disclose, or convey to any third party, either directly or indirectly, the contents of this software. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile this software or alter or remove any proprietary rights or copyrights notice or identification which indicates Intuisphere’s ownership of this software. You shall not create any derivative works or other works that are based upon or derived from WebAcappella in whole or in part. Intuisphere retains sole and exclusive ownership of all rights, titles and interest in and to this software and all intellectual property rights relating thereto. This software is protected without limitation by French copyright law and international copyright treaty provisions.
All rights not expressly granted hereunder are reserved for Intuisphere. 2.8 Intellectual Property Rights: templates The images and vectors included in the templates in WebAcappella are subject to copyright and other intellectual property rights under local and international legal conventions. You can only use the images and the templates for your own website created with WebAcappella, and not for resale.

You shall not make any modifications, duplicates, or distribute, display, sublicense, retransmit, reproduce, or create derivative works from the transfer, sale or other use of this content by itself or on any other support. You shall not remove any notices of copyright that may appear on or embedded in images. In addition, you agree that you will not use these images or templates in a way that places them in a bad light or depicts them in a way that may be offensive to some - this includes, but is not limited to: (1) the use of works in pornography; (2) tobacco advertisements; (3) advertisements for adult entertainment clubs or similar venues, including escort or similar services; (4) political endorsements; (5) uses that are defamatory, or otherwise contain unlawful, offensive or immoral content. IN NO EVENT SHALL WEBACAPPELLA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM YOUR FAILURE TO COMPLY WITH THE OBLIGATIONS INDICATED ABOVE. 2.9 Limitation of Responsibility - You will indemnify, hold harmless, and defend Intuisphere and its employees against any and all claims, proceedings, demands and costs resulting from or in any way connected with your use of this software.
